FAQ - Frequently Asked Questions

1.

Do I need to do anything before I call to start estate planning?

2.

No. We make it easy as possible for you to get started creating your own estate plan, so we start with just a call. It is recommended that you jot down any questions or critical points you'd like to address during our Planning Meeting.

What is the difference between a will and a trust?

A will is a document that specifies your wishes for your estate after your death, including who will inherit your assets. A trust, on the other hand, allows you to manage your assets during your lifetime and specify how they should be distributed after your death. Trusts can offer benefits such as avoiding probate, privacy, and providing for minor children or family members with special needs.

3.

What should I do if I'm named as an executor or trustee?

As the Executor, your role involves several key responsibilities, including filing the will with the local probate court, notifying beneficiaries, managing the deceased's assets, paying off any debts and taxes, and distributing the estate according to the will. We provide comprehensive support to navigate these duties, ensuring compliance with legal requirements and easing the burden during this challenging time.

4.

My deceased parent’s name is still on the deed, can you help?

We specialize in resolving the unique challenges and legal nuances involved in transferring property inheritances to heirs. Schedule a Discovery Call and uncover how we can help.

5.

Do I need a will, and what happens if I don’t have one?

Executing a will is important as it outlines your wishes for the distribution of your assets and care for any minor children. If you pass away without a will, your estate will be distributed according to state laws, which may not align with your preferences, potentially leading to family disputes and additional legal challenges.

6.

How often should I update my estate plan?

You should review and possibly update your estate plan after major life events, such as marriage, divorce, the birth of a child, significant changes in assets, or moving to a new state. It's also wise to review your plan periodically, at least every five years, to ensure it still reflects your wishes.
